These Terms of Service govern the contractual relationship between Pfeitec (hereinafter referred to as "Provider", "we", "us") and the users of the website https://www.getlaunch.it (hereinafter referred to as "User", "you").

1.1 Definition of Terms:

• Consumer: Any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
• Businessman: A natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
• Platform: The website https://www.getlaunch.it, operated by Pfeitec.
• LaunchIt: A NextJS project with preconfigured functions like authentication, payments, and more, which is the primary product offered through the Platform.

1.2 Scope of Terms:

These Terms of Service apply to all transactions, services, and offers made through our Platform. By accessing or using our Platform, you agree to be bound by these Terms of Service. Personal terms and conditions of Users will not be recognized unless we expressly agree to their validity in writing.

2.1 Contract Formation:

The presentation of LaunchIt on our Platform does not constitute a legally binding offer but rather an invitation to submit an offer. By completing the ordering process, you are submitting a binding offer to purchase access to LaunchIt.

2.2 Order Process:

1. Select LaunchIt product
2. Proceed to checkout
3. Provide necessary personal and payment information
4. Review your order
5. Submit your order by clicking the "Buy Now" or equivalent button

2.3 Order Confirmation:

A contract is formed when we accept your offer by sending an order confirmation via email. This email will include all relevant order details. Please ensure that the email address you provide is accurate and that you check your inbox (including spam folders) regularly.

2.4 Communication Requirements:

All communication regarding your order, account, and usage of LaunchIt will be conducted via email. It is your responsibility to ensure that you can receive emails from our domain and that you regularly check the email address associated with your account.

3.1 Available Payment Options:

We currently offer the following payment methods:

• Stripe: Credit cards, debit cards, and other payment methods supported by Stripe
• Bank Transfer: For bank transfers, please contact our support at [email protected] for payment instructions

3.2 Payment Processing:

Payment processing is handled by our trusted partners. When using Stripe, your payment information is processed directly by Stripe in accordance with their terms of service and privacy policy. We do not store your full payment details on our servers.

3.3 Special Terms for Bank Transfers:

For bank transfers, access to LaunchIt will be granted only after the full payment has been received and confirmed. Please include your order number in the payment reference to expedite this process.

4.1 Description of Digital Products:

LaunchIt is a NextJS project with preconfigured functions including authentication, payments, and other features designed to accelerate web development. It is provided as digital content in the form of source code.

4.2 Delivery of Digital Content:

Upon successful payment, you will receive an invitation to the GitHub repository containing the LaunchIt code. This invitation will be sent to the email address associated with your account.

4.3 Access and Download Information:

To access the code, you must have a GitHub account. If you do not have one, you will need to create one. Instructions for accessing the repository will be provided in the invitation email. The code can be downloaded from the GitHub repository following standard Git workflows.

5.1 Ownership:

All intellectual property rights to LaunchIt, including but not limited to copyright, trademarks, and trade secrets, remain the exclusive property of Pfeitec. Purchase of LaunchIt grants you a license to use the code as specified in these Terms, but does not transfer ownership of the intellectual property.

5.2 License Terms:

Upon purchase, you are granted a non-exclusive, non-transferable license to use LaunchIt for both private and business purposes. You may modify the code to suit your needs. This license is personal to you and cannot be sublicensed, assigned, or transferred to any third party without our express written consent.

5.3 Usage Limitations:

You are expressly prohibited from:

• Distributing the LaunchIt code or any derivative works to third parties
• Selling, renting, leasing, or otherwise transferring the LaunchIt code
• Creating competing products based on LaunchIt
• Removing or altering any copyright notices or other proprietary markings
• Using LaunchIt for any illegal purposes

6.1 Code Warranty:

We strive to provide high-quality and functional code. However, LaunchIt is provided "as is" and "as available" without any express or implied warranty. We do not guarantee that the code is error-free or suitable for any particular purpose.

6.2 Reporting Issues:

If you discover bugs or issues in the code, we request that you create a GitHub Issue in our repository. Please describe the problem in as much detail as possible, including reproduction steps, expected behavior, and actual behavior. This helps us identify and fix the issue efficiently.

6.3 Limitation of Liability:

We shall be liable without limitation for damages resulting from injury to life, body, or health, for damages caused by intent or gross negligence, and for damages covered by liability under the German Product Liability Act.

For damages caused by slight negligence, we shall be liable only in case of breach of a material contractual obligation (cardinal obligation) and only for foreseeable damages typical for this type of contract. Our liability for all other damages is excluded.

7.1 Account Creation:

To purchase and access LaunchIt, you may need to create an account on our Platform. You are responsible for providing accurate and complete information during the registration process and for keeping your account credentials secure.

7.2 User Responsibilities:

You are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any losses or damages arising from your failure to maintain the security of your account credentials.

7.3 Termination Conditions:

You may request the deletion of your account at any time by contacting [email protected]. We reserve the right to suspend or terminate your account if you violate these Terms of Service or if we have reason to believe that your account is being used for fraudulent or illegal activities.

Account termination does not affect your license to use LaunchIt if you have already purchased it, but you will no longer have access to updates, support, or other services associated with your account.

8.1 Refund Conditions:

Refunds for LaunchIt are possible within 7 days of purchase. To request a refund, you must provide a reason for your refund request. As LaunchIt is a digital product, you must also confirm that you have deleted all copies of the code from all storage locations where you have saved it.

8.2 Refund Process:

To request a refund, please contact us at [email protected] with the following information:

• Your order number or the email address used for purchase
• Date of purchase
• Reason for requesting a refund
• Confirmation that you have deleted all copies of LaunchIt

8.3 Refund Exceptions:

Refunds will not be provided after the 7-day period has elapsed, or if we determine that you have not deleted all copies of LaunchIt, or if you continue to use LaunchIt after requesting a refund.

9.1 Governing Law:

These Terms of Service and all legal relationships between us and our Users shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

9.2 Jurisdiction for Business Customers:

If you are a businessman, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms of Service shall be Würzburg, Germany.

9.3 Consumer Protection:

If you are a consumer, the statutory provisions regarding jurisdiction shall apply. However, the mandatory consumer protection regulations of the country in which you have your habitual residence shall remain unaffected by the choice of law and jurisdiction.

10.2 Alternative Dispute Resolution:

10.3 Dispute Resolution Participation:

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

11.1 Technical Steps for Contract Conclusion:

The technical steps for concluding a contract on our Platform are as follows:

1. Selection of LaunchIt
2. Adding LaunchIt to the shopping cart
3. Proceeding to checkout
4. Entering and verification of personal and payment information
5. Review of order details
6. Submission of order by clicking the "Buy Now" or equivalent button
7. Receipt of order confirmation via email

11.2 Error Correction Options:

Before submitting your order, you will have the opportunity to review and correct any errors in your order information. You can use the browser's back button to return to previous pages and make corrections, or you can cancel the ordering process and start over.

12.1 Contract Language:

The contract language is English. All communications, notifications, and documents related to the contract will be provided in English.

12.2 Contract Text Storage:

The contract text will be stored by us but will not be accessible to you directly. We will send you the order confirmation via email, which will include the essential contract terms. We recommend that you save or print this email for your records.

13.1 Total Price Information:

All prices displayed on our Platform are final prices including the statutory value-added tax (VAT). The total price for LaunchIt will be clearly displayed during the checkout process before you submit your order.

13.2 Digital Delivery:

As LaunchIt is delivered digitally, there are no shipping or delivery fees.

13.3 International Tax Considerations:

If you are ordering from outside the European Union, you may be subject to import duties, taxes, or other charges imposed by your country of residence. You are responsible for paying any such charges.

13.4 Payment Due Dates:

Payment for LaunchIt is due immediately upon conclusion of the contract. Access to LaunchIt will be granted only after the payment has been successfully processed.

14.1 Notification of Changes:

We reserve the right to modify these Terms of Service at any time. If we make material changes to these Terms, we will notify you via email or by posting a notice on our Platform at least 14 days before the changes take effect.

14.2 Acceptance of Updated Terms:

Your continued use of our Platform and LaunchIt after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using our Platform and LaunchIt.
